1. Acceptance of Terms

By downloading, installing, or using "What's in my mind?" (the "App"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, do not use the App.

The App is published by Nicolas Nieddu.

2. Description of the App

"What's in my mind?" is a party guessing game where players place their phone on their forehead and try to guess words or images displayed on the screen based on hints from other players.

The App includes:

• Pre-built word categories
• Custom category creation
• Video and photo replay features
• Game history and rankings

3. Eligibility

The App is intended for users aged 13 and older.

By using the App, you represent that you are at least 13 years old. If you are under 18, you must have permission from a parent or guardian to use the App.

4. User Conduct

When using the App, you agree NOT to:

• Create custom categories containing offensive, illegal, or inappropriate content
• Use the App for any illegal purpose
• Attempt to hack, modify, or reverse engineer the App
• Use the App in a way that could harm other users
• Violate any applicable laws or regulations

We reserve the right to remove any content that violates these Terms.

5. Intellectual Property

5.1 Our Content

All content in the App, including but not limited to graphics, logos, sounds, and code, is owned by Nicolas Nieddu and is protected by intellectual property laws.

5.2 Your Content

You retain ownership of custom categories and content you create. By using the App, you grant us no rights to your personal content.

5.3 Restrictions

You may not:

• Copy, modify, or distribute any part of the App
• Use the App's content for commercial purposes without permission
• Remove any copyright or proprietary notices

6. Advertisements

The App displays advertisements through Google AdMob. By using the App, you acknowledge that:

• Ads may be displayed during your use of the App
• Ad content is provided by third parties and we are not responsible for it
• You can choose to see non-personalized ads

Some features may require watching rewarded ads to unlock.

7. In-App Purchases

The App may offer in-app purchases to remove ads or unlock premium features.

7.1 Purchase Processing

• All purchases are processed exclusively through the App Store (iOS) or Google Play Store (Android)
• Prices are displayed in your local currency including applicable taxes
• Payment is processed by Apple or Google according to their terms

7.2 Right of Withdrawal

By completing a purchase, you acknowledge that:

• The digital content will be delivered immediately
• You expressly waive your 14-day right of withdrawal
• The purchase is final once the content is delivered

7.3 Refunds

• Refund requests must be directed to Apple (App Store) or Google (Play Store)
• We do not process refunds directly
• Refund eligibility is determined by Apple or Google's policies

8. Disclaimer of Warranties

We do not warrant that:

• The App will be error-free or uninterrupted
• The App will meet your specific requirements
• Any errors will be corrected

Your use of the App is at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NICOLAS NIEDDU SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, or consequential damages
• Loss of data or profits
• Damages resulting from your use or inability to use the App

Our total liability shall not exceed the amount you paid for the App (if any).

10. Indemnification

You agree to indemnify and hold harmless Nicolas Nieddu from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of third parties

11. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by updating the "Last updated" date.

Your continued use of the App after changes constitutes acceptance of the new Terms.

12. Termination

We may terminate or suspend your access to the App at any time, without notice, for:

• Violation of these Terms
• Conduct that we determine is harmful to other users or the App

You may stop using the App at any time by uninstalling it.

13. Governing Law

These Terms are governed by the laws of France.

Any disputes arising from these Terms shall be resolved in the courts of France.

14. Dispute Resolution

14.1 Amicable Resolution

14.2 Consumer Mediation (EU)

In accordance with Article L612-1 of the French Consumer Code, if you are a consumer in the European Union, you have the right to use a consumer mediator free of charge in case of an unresolved dispute.

For disputes related to purchases, please contact Apple or Google's customer service first, as they process all transactions.

14.3 Online Dispute Resolution
